  1. Treat others with respect

    GradeGuru is all about helping each other. Please treat your fellow site users and members with respect. Do unto others…

  2. Don’t rip off other people’s work

    Post only what you create and own. Notes and materials created by your university, college, school, professors, lecturers, tutors, or other publishers are not yours to give. Posting the work of others as if it is your own is theft – this is a black and white issue as far as GradeGuru is concerned. Don’t do it. Including some lines from a Shakespeare sonnet in an English poetry essay is OK. Borrowing material chunks of your English lecturer’s detailed handout on Shakespeare’s poetry isn’t. GradeGuru can’t lecture You on international copyright law – You know if you are doing something wrong.

  3. This is for your personal research use

    GradeGuru is for your own personal use ONLY. No collecting information about other users to send spam. No advertising. No copying, no publishing, no redistribution. Thanks.

  4. No plagiarism or cheating

    GradeGuru seeks to raise the educational playing field, not level it. You agree that we may supply Your Content (including that supplied prior to the version date of these Terms) to providers of anti-plagiarism tools at our discretion, so that such providers may, amongst other things, check the integrity of Your Content. Content posted by Users is only the start of your course and revision work, not an end in itself. Cheap plagiarism of material portions of essays and course work etc (a) is not the goal of GradeGuru (b) will not help you learn more, better or faster and (c) may be spotted by us and by teachers and examiners who use increasingly sophisticated anti-plagiarism tools (d) undermines the serious educational purpose of GradeGuru Services and (e) is a waste of your time. GradeGuru is not the lazy path to qualifications. It is a serious educational tool for those who want to be better educated, not just look better educated. GradeGuru does not want to alienate schools and teachers. We hope to earn their respect and participation.

  5. Take note if we remove your Content

    It is entirely up to us if we want to remove all or part of your Content at any time, for example if it is not up to quality standards or it is in breach of these Community Standards. If we remove all or part of Your content, you can ask why, but please accept our explanation. When Users alert GradeGuru to inappropriate Content, we examine it and reach our own conclusion.

  6. We’re not responsible for what others post

    GradeGuru is not responsible for Content posted at GradeGuru, even if from time-to-time GradeGuru monitors the site. Please use your judgement.

  7. Don't Mess With GradeGuru or its members

    Don’t publicly post others’ telephone numbers, street addresses, names and, obviously, no nudity, obscenity, defamatory, libelous or violent postings. Sometimes GradeGuru must report to the Police or other public authorities the posting of certain Content, whether we like it or not. GradeGuru aims to promote advances in education, not to shock, degrade or upset people, nor to change governments or public policy. GradeGuru respects and promotes free speech, but, there are limits to what GradeGuru can or will publish. If your grandmother would be upset by seeing it stuck on the front of her house, don’t post it on GradeGuru.

  8. Don’t Look for Loopholes

    Please accept our Terms and respect their purpose. Don’t seek loopholes. If GradeGuru finds You using loopholes, GradeGuru will shut Your account & amend the Terms to close the loophole.

  9. GradeGuru is about Education

    GradeGuru is a community for students (and those who teach them) to publish their work and to improve the quality of their studies and the quality of what is taught to them in the long run. GradeGuru Users can improve GradeGuru continually if they behave as a proactive community. You may receive rewards for the Content you post if it is viewed and rated by other Users but you could also lose your rewards if we feel we have to remove your Content and/or end your membership. Please use the site for educational purposes only.

  10. Don’t Just Sit There

    Share and share alike There's a lot here to see, and lots of Users posting great notes - You can be one of them. Don’t just sit there using what others have posted, return the favour by posting high quality content that will stimulate and help others.

  12. Report Abuses – If Content offends You or if you see others breaking the Terms, please immediately contact reportdisrespect@gradeguru.com. We won’t identify you to anybody else. We are grown ups. We will look at the Content and reach our own decision.

  13. No second chances: GradeGuru has the right to terminate your access for any or no reason, with or without notice.

TERMS & CONDITIONS OF USE

  1. GradeGuru is an online educational community where students publish their educational course and revision work to others (all together “Users”). The McGraw-Hill Companies, Inc. (of 1221 Avenue of the Americas New York New York 10020-1095 USA) trading as GradeGuru ("GradeGuru") offers the GradeGuru.com website ("GradeGuru Website") and other features, content, or applications offered from time to time in connection with the GradeGuru Website (collectively, "GradeGuru Services").
  2. Terms of Use. By (and in consideration of) using GradeGuru Services, You agree to be bound by these terms of Use ("Terms") and our Privacy Statement. Read these Terms carefully and save them. You can obtain a copy of these Terms by emailing us at: communitystandards@gradeguru.com. If You disagree with them, please immediately stop using GradeGuru Services.
  3. GradeGuru may require You to download software or content to enable you to use some GradeGuru Services and/or therefore agree to more terms and conditions: these will become part of these Terms.
  4. GradeGuru may change the Terms occasionally, by posting changes on the GradeGuru Website. You will be bound by any such changes if you use the GradeGuru Services after they have been posted. You must review the posted Terms regularly to be updated about changes.
  5. Fees. GradeGuru is entitled to charge at any time for GradeGuru Services (for example, by way of a subscription fee or by charging You to view other Users Content and other Users to view Your Content) and to change its fees from time to time at its discretion. If GradeGuru ends your membership, you are not entitled to a refund of any unused portion of any fees and you may forfeit any points you may have earned under any reward scheme.
  6. Your Profile. You must ensure that your GradeGuru profile and all information about You excludes telephone numbers, street addresses, last names, and anything which breaches Clause 22 below.
  7. Content and use. GradeGuru assumes no responsibility or liability for any material provided by Users (in Profiles or Content), so it may contain material which is inaccurate, incomplete, inappropriate, offensive or sexually explicit. If you learn of misuse of the GradeGuru Services by anybody, please immediately contact GradeGuru or click on the "Report Abuse" link at the bottom of any GradeGuru page.
  8. GradeGuru can, in its sole discretion, reject, refuse to post or remove all or any part of any Content and/or posting (including private messages) by You, or restrict, suspend, or terminate Your access to all or any part of GradeGuru Services at any time, for any or no reason, with or without prior notice, and without liability.
  9. Rewards. GradeGuru may offer reward schemes to reward You according to (i) the number of Users who view your Content and/or (ii) how well Users rate your Content and/or (iii) how well GradeGuru rates Your Content. These rewards will be entirely at GradeGuru’s discretion and can be revoked at anytime, if for example, all or part of your Content breaches these Terms or our Community Standards or is not up to quality standards. In such cases you will forfeit any points You may have earned under any reward scheme and You will not receive any future points for any Content that remains on the GradeGuru Website, however GradeGuru will do its best to recognise any points You may have earned in circumstances where it feels you have properly earned such points and you are not at fault. If you receive any rewards they will be forwarded to the contact details you provide, so You need to make sure they are up to date.
  10. Eligibility. Use or membership of GradeGuru Services is void where prohibited by law. By using GradeGuru Services, You represent and warrant that (a) all registration information You submit is true and accurate; (b) You will maintain the accuracy of such information; (c) You are at least sixteen 16 years of age; and (d) Your use of the GradeGuru Services does not breach any applicable law or regulation.
  11. Term. You may end your membership at any time for any reason, by following the instructions at the User Profile Screen. Ending your membership means that You will not be able to access the GradeGuru Services and post more Content, however, the Content that you have already posted will remain on the GradeGuru Website unless we, in our sole discretion, decide to remove it. Even after membership ends, these Terms therefore remain in effect.
  12. Password. You must keep Your password secret. You must not use the account, username, or password of any other User at any time or to disclose Your password to anybody else. You must tell GradeGuru immediately if You suspect any unauthorized use of or access to Your account and/or password. You alone are responsible for any and all use of Your account.

  13. Non-commercial Use. GradeGuru Services are for Your personal use only. You must not use them for any commercial purpose. Illegal and/or unauthorized use of the GradeGuru Services, including collecting information about Users by any means in order to send unsolicited email and/or unauthorized framing of or linking to the GradeGuru Website is prohibited.

    You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the GradeGuru Website in a manner that sends more request messages to its servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. However, GradeGuru does allow operators of public search engines to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but prohibits the creation of archives of such materials. You agree not to collect any personally identifiable information, including account names, from the GradeGuru Website.

    You shall not transmit any chain letters or junk email to other Users. You must not use any information obtained from GradeGuru Services in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent. In order to protect Users, GradeGuru can restrict the number of emails which Users may send to each other in any 24-hour period. If You send unsolicited bulk email, instant messages or other unsolicited communications of any kind through the GradeGuru Services, You accept that You will cause substantial harm to GradeGuru, but that the amount of such harm will be very hard to ascertain. As a reasonable estimate of such harm, You agree to pay GradeGuru 10USD for each such unsolicited email or other unsolicited communication You send through the GradeGuru Services.

  14. Proprietary Rights in GradeGuru Content. GradeGuru does not claim ownership of the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you may post to the GradeGuru Services. By posting any Content on or through the GradeGuru Services, you hereby grant to GradeGuru a non-exclusive worldwide perpetual license to use, modify, publicly perform, publicly display, reproduce, and distribute all or part of such Content on and through the GradeGuru Services and through GradeGuru and its affiliated entities, other off-line services and products and to charge for access to and/or use of Your Content. This license granted by You to GradeGuru to use Your Content (including that supplied prior to the version date of these Terms) includes (without limitation) the right for GradeGuru supply Your Content to providers of anti-plagiarism tools at our discretion, so that such providers may, amongst other things, check the integrity of Your Content.
  15. GradeGuru needs this License to provide GradeGuru Services. Without the right to modify Content, GradeGuru cannot digitally compress Content or otherwise format Content to satisfy technical requirements, and without a right to publicly perform Your Content, GradeGuru cannot allow Users to view/listen to files posted by You.
  16. Your license to GradeGuru is (a) subject to rewards provided by GradeGuru from time to time in its discretion, (b) sublicensable, so GradeGuru can use affiliates and subcontractors (like internet content delivery networks and service partners and collaborators) to provide some or all GradeGuru Services, (c) worldwide (because the Internet and GradeGuru Services have global reach) and (d) perpetual so it continues even after you cease to be a registered User.
  17. You represent and warrant that: (i) You created and so You own all Content provided by You to GradeGuru and all rights in such Content including without limitation copyright and (ii) the posting of Your Content on or through GradeGuru Services will not breach the privacy rights, publicity rights, copyrights, contract rights or any other rights of anybody. You agree to pay for all royalties, fees, and any other monies owing to anybody by reason of any Content provided by You to GradeGuru. You also agree to pay any charges GradeGuru may request from You for viewing other Users Content. You will exclude from Content any documents, records or files made accessible to You by (a) Your school/college or teacher employed by Your school/college (b) any board of examination or (c) any author or publisher whose works you have used as part of your studies or (d) any co-student.
  18. GradeGuru Services contain material provided by GradeGuru, excluding the Content of other Users ("GradeGuru Material"). GradeGuru Material is protected by intellectual property and other laws, and GradeGuru owns and retains all rights in the GradeGuru Material and GradeGuru Services. GradeGuru grants to You a limited, personal, revocable, non transferable license to reproduce and display the GradeGuru Material (excluding any software code) solely for your personal educational use.
  19. GradeGuru Services also contain Content of other Users and other third parties. Except for Content posted by You, You agree not to copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the GradeGuru Services other than by downloading and printing for Your own personal educational research use alone.
  20. Content Posted. GradeGuru is entitled to delete all or part of any Content that in its sole discretion breaches these Terms or the Community Standards, is not up to quality standards or which may be offensive, illegal or violate the rights, harm or threaten the safety of any person. GradeGuru is not responsible for monitoring GradeGuru Services for inappropriate Content or conduct. Even if GradeGuru chooses to monitor GradeGuru Services, GradeGuru assumes no responsibility for Content, no obligation to modify or remove inappropriate Content, and no responsibility for the conduct of any User submitting such Content.
  21. You alone are responsible for Content posted by You on or through any GradeGuru Services, and for any material or information that you transmit to other Users and for your interactions with other Users. GradeGuru does not endorse and or control Your and/or anybody else’s Content. Content is not reviewed by GradeGuru before posting and does not reflect GradeGuru’s opinions or policies. You cannot remove any Content once you have posted it, only GradeGuru can do this.
  22. Content/Activity Prohibited. Below is a non-exhaustive list of Content that is illegal or prohibited by GradeGuru from being posted on or through the GradeGuru Services:

    (a)is offensive or promotes racism, bigotry, hatred or physical harm of any kind against any person group or animal;

    (b)contains nudity, violence, or offensive subject matter or contains a link to an adult website;

    (c)provides telephone numbers, street addresses, last names, URLs or email addresses;

    (d)promotes information that You know or have good reason to think is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

    (e)promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

    (f)involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";

    (g)contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);

    (h)furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

    (i)solicits passwords or personal identifying information for commercial or unlawful purposes from other persons or from anyone under sixteen (16); and

    (j)includes a photograph of another person without that person's consent.

  23. Below is a non-exhaustive list of activities that are illegal or prohibited on the GradeGuru Website and through use of GradeGuru Services:

    (a)criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;

    (b)advertising to, or soliciting of, any User to buy or sell any products or services through the GradeGuru Services;

    (c)covering or obscuring the banner advertisements on your personal profile page, or any GradeGuru page using HTML/CSS or any other means;

    (d)interfering with, disrupting, or creating an undue burden on the GradeGuru Services or the networks or services connected to the GradeGuru Services;

    (e)attempting to impersonate another person;

    (f)selling or otherwise transferring Your profile;

    (g)using any information obtained from GradeGuru Services to harass, abuse, or harm another person; and

    (h)distorting or seeking (Yourself or in conspiracy with others) to distort of falsify the outputs of GradeGuru systems or processes designed to determine how many Users use Your Content or how well Users rate Your Content. Such distortion or efforts to cause distortion may constitute fraud, attempted fraud or conspiracy to commit fraud.

    GradeGuru is entitled to investigate and take appropriate legal action against anyone who, in GradeGuru’s sole discretion, breaches Clause 22 and/or Clause 23 including without limitation, removing such material from GradeGuru Services, suspending or terminating Your access to GradeGuru Services and reporting You to relevant authorities.

  24. Copyright Policy. You agree that You will not (using GradeGuru Services) post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information ("Intellectual Property") belonging to others without obtaining the prior written consent of the owner of such proprietary rights. GradeGuru will terminate membership privileges of any User who infringes the Intellectual Property of others upon receipt of notice to GradeGuru by or for the rights owner.
  25. Disputes. You alone are responsible for your interactions with other Users. GradeGuru is entitled but not obliged, to monitor disputes between you and other Users.
  26. Privacy. Use of the GradeGuru Services is also governed by our Privacy Statement, which is incorporated into this Agreement. Please go to the GradeGuru homepage at www.gradeguru.com and click on the Privacy Statement link to view our Privacy Statement. By using the GradeGuru Services, you agree that we may use your information as further set out in the Privacy Statement and you consent to having your personal data transferred to and processed in the US, where GradeGuru services are hosted.
  27. Disclaimers. GradeGuru is not responsible for any incorrect or inaccurate Content posted in connection with the GradeGuru Services, whether caused by users of GradeGuru Services or by any of the equipment or programming associated with or utilized in GradeGuru Services. GradeGuru does not guarantee that any GradeGuru Material is correct and accurate and is not responsible for any errors or omissions or for any consequences of the use of such information. Profiles created and posted by Users on the GradeGuru Website may contain links to other websites. GradeGuru is not responsible for the Content, accuracy or opinions expressed on such websites and inclusion of any linked website on GradeGuru Services does not imply approval or endorsement of the linked website by GradeGuru. If you access third-party sites, You do so at your own risk. GradeGuru takes no responsibility for third party advertisements which are posted on the GradeGuru Website or through GradeGuru Services, nor does it take any responsibility for the goods or services provided by its advertisers. GradeGuru is not responsible for the conduct, whether online or offline, of any User of GradeGuru Services. GradeGuru assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communication. GradeGuru is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, or failure of any email due to technical problems or traffic congestion on the Internet or on any of GradeGuru Services or combination thereof, including any injury or damage to any person's computer related to or resulting from participation or downloading materials in connection with GradeGuru Services. Under no circumstances shall GradeGuru be responsible for any loss or damage, resulting from use of GradeGuru Services, attendance at a GradeGuru event, from any Content posted on or through GradeGuru Services (including, without limitation, from any use of or reliance on any such Content), or from the conduct of any users of GradeGuru Services, whether online or offline. GradeGuru Services are provided "AS-IS" and as available and GradeGuru expressly disclaims any warranty of fitness for a particular purpose or non-infringement. GradeGuru cannot guarantee and does not promise that the GradeGuru Services will always be available and neither can it guarantee or promise any specific results from use of GradeGuru Services and in particular does not promise that Users’ educational exam or course work grades will improve thereby.
  28. Limitation on Liability. IN NO EVENT SHALL GRADEGURU BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF GRADEGURU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, GRADEGURU'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO GRADEGURU FOR GRADEGURU SERVICES UP TO THE DATE WHEN THE CAUSE OF ACTION FIRST ARISES.
  29. U.S. Export Controls. Software available in connection with GradeGuru Services (the "Software") is further subject to United States export controls. No Software may be downloaded from GradeGuru Services or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.
  30. Disputes. If there is any dispute about or involving GradeGuru Services, you agree that the dispute shall be governed by the laws of the State of New York, USA, without regard to conflict of law provisions and You agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of New York, City of New York. Either GradeGuru or You may demand that any dispute between GradeGuru and you about or involving GradeGuru Services must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in New York City, New York, USA, provided that the foregoing shall not prevent GradeGuru from seeking injunctive relief in a court of competent jurisdiction.
  31. Indemnity. You agree to indemnify and hold GradeGuru its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of GradeGuru Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of Your representations and/or warranties set forth above and/or if any Content that you post on the GradeGuru Website or through the GradeGuru Services causes GradeGuru to be liable to another.
  32. Other. These Terms and the Privacy Statement are accepted upon Your use of any GradeGuru Services. These Terms and the Privacy Statement constitute the entire agreement between You and GradeGuru for use of GradeGuru Services. The failure of GradeGuru to exercise or enforce any right or provision of these Terms and the Privacy Statement shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. GradeGuru is a valuable trademark of The McGraw-Hill Companies, Inc. for which there are trademark registrations and/or applications for such registrations in a number of territories. These Terms and Privacy Statement operate to the fullest extent permissible by law. If any provision of these Terms and/or Privacy Statement are unlawful, void or unenforceable, that provision is deemed severable from these Terms and/or Privacy Statement and does not affect the validity and enforceability of any remaining provisions.
